Terms of Service

These terms govern the purchase and use of software sold by Edison Pereira da Costa Filho, an individual trading as Guppylab, based in Brazil ("Guppylab", "we"). By buying or using our software you agree to them.
1. What we sell
Guppylab sells plugins for NativePHP Mobile: source-code packages that developers embed in applications they build. Products and their prices are listed on this website. Purchases are one-time; there is no subscription and no recurring charge.
2. Merchant of record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service enquiries and handles returns. Your purchase is also subject to Paddle's own buyer terms.
3. Licence
On payment you receive a non-exclusive, non-transferable, worldwide licence to use, modify and embed the software in an unlimited number of applications, and to distribute those applications in compiled form.
The licence is granted to one legal entity. A group company, a client, or a contractor working on its own products needs its own licence.
You may not redistribute, publish, sublicense, sell, rent or lend the software in source form, whether modified or not; distribute it other than embedded in an application, where it cannot be extracted for separate use; remove copyright or licence notices; or use it to build a product that competes with it.

4. Delivery
The software is delivered through a private Composer repository. Access credentials are issued after payment is confirmed and sent to the email address given at checkout. Delivery is electronic; nothing is shipped.
5. Third-party services
Some of our software communicates with services operated by third parties — routing providers, Apple Push Notification service, Firebase Cloud Messaging. Choosing a provider, paying it, complying with its terms and displaying whatever attribution it requires are your responsibility. We are not a party to that relationship and provide no quota, credential or coverage under it.
6. Support
Support is provided by email at suporte@guppylab.com.br, in English or Portuguese. We aim to answer within five business days. Support covers defects in our software; it does not cover your application, your infrastructure, or third-party services.
7. Warranty
The software is provided "as is", without warranty of any kind, express or implied, including the warranties of merchantability, fitness for a particular purpose and non-infringement.
8. Liability
To the maximum extent permitted by applicable law, our aggregate liability arising out of or relating to the software is limited to the amount you paid for it. We are not liable for indirect, incidental, special or consequential damages, or for loss of profits, data or business.
Nothing here excludes liability that cannot be excluded under applicable law, including wilful misconduct, gross negligence, and injury to life, body or health. Nothing here limits any right you have as a consumer under the Brazilian Consumer Protection Code (Law 8.078/1990) or under mandatory law in your own country.
9. Termination
This licence terminates automatically if you breach it. On termination you must stop distributing applications containing the software. Applications already distributed to end users are not affected.
10. Changes
We may change these terms. Changes apply to purchases made after they are published on this page. The version in force when you bought governs your purchase.
11. Governing law
These terms are governed by the laws of Brazil. Mandatory consumer protections of your country of residence are unaffected.
